Class Action Settlements

  • Class actions against credit card companies for improper treatment of consumers including improperly charging interest, late fees, and over the limit fees. Strange & Carpenter acted as lead counsel in the following successful settlements:
    • Boehr v. Bank of America, U.S.D.C. District of Arizona Case No. CIV-99-2265-PHX-RC (settlement for $4.75 million)
    • Schwartz, et al. v. Citibank, (South Dakota), N.A., Case No. 00-00075 LGB (JXJx) (settlement for $36 million)
    • Mayemura, et al. v. Chase Manhattan Bank, Case No. 00-00753 LGB (JWJx) (settlement for $22.5 million)
    • Klausner v. First Union Direct Bank, NA, Case No. 00-4267 LGB (AJWx) (settlement for $3 million)
    • Shea, et al. v. Household Bank (SB), National Association, OCSC Case No. OOCC12585. (settlement for $16 million)
    • Boehr v. American Express Centurion Bank, LASC Case No. BC 256499 (settlement for $8.2 million)
    • Edelist v. First USA Bank, NA, OCSC Case No. 02CC00294 (settlement for $7 million)
    • Schoshinski v. Fleet Bank (RI), National Association in Rhode Island, LASC Case No. BC 262105 consolidated with Landrenau, et al. v. Fleet Financial Group, U.S.D.C. - Middle District of Louisiana, Case No. 01-26-B-MI (settlement for $3.5 million)
    • Edell v. Bank of America, NA (USA), Arizona Superior Court Case No. C-20010051 (settlement for $4.2 million)
    • Shea, et al. v. Discover Bank, OCSC Case No. OOCC12582 (settlement value of $15 million)

  • Class actions against workers' compensation insurance carriers for improperly charging premiums to California employers. Strange & Carpenter represents classes which include most California employers against workers' compensation insurance carriers for improperly inflating premiums as a result of the misreporting of claims. Between 1988 and 1999, various cases settled on a classwide basis including:
    • Superior Construction, Inc. v. Argonaut Insurance Company, et al., L.A.S.C. Case No. BC 221028 (settlement for $3 million)
    • Blake H. Brown v. Fremont Compensation Insurance Company, L.A.S.C. Case No. BC 180443 (settled for $25 million)
    • 3 Day Blinds, Inc. v. ULICO Standard of America, L.A.S.C. Case No. BC 170432 (settled for $1.299 million)
    • Academy Tent and Canvas, Inc. v. Pacific Compensation Insurance Company, L.A.S.C. Case No. BC 161060 (partial settlement for $1 million)
    • Designer Imports International, Inc. v. Fairmont Insurance Company, LASC Case No. BC184256 (settlement $6.2 million)

     

  • Strange & Carpenter has also been involved with the following settlements:
    • MacGregor v. Schering-Plough Corporation, et al., L.A.S.C. Case No. BC 248041
      (settlement value to consumers for $202,500,000)
    • McKernan, et al. v. Black & Decker Corp., et al., S.C.S.C. Case No. CV 772488. This case involved defective Heat Mirror™ Units which fogged-up when exposed to sunlight as a result of a defective sealant. The case recently settled for $13 million against all defendants.
